Terms of Service

GiftCue - Effective: May 14, 2026 - Last updated: May 14, 2026

By using GiftCue, you agree to these Terms. If you don't agree, don't use the service.

1. What GiftCue is

GiftCue is a software service that helps you (the "Sender") give a gift to someone you care about (the "Recipient"). You answer questions about the Recipient. Our AI generates a personalized picker with 12 gift options. We send you a link to share with the Recipient. They pick one, and you arrange the gift.

GiftCue is operated by True Grit Toolkits LLC, an Oregon limited liability company (Oregon Registry #243310695), under Oregon Assumed Business Name registration #257359597 ("GiftCue"). Sole member: Jason Johnson. Principal place of business: 1275 Monroe St, Eugene OR 97402.

2. Eligibility

You must be at least 18 years old to create an account or pay for the service. By signing up, you confirm you are 18+.

3. Your account

• You're responsible for keeping your sign-in email secure.
• One human, one account. Don't share credentials.
• If you suspect unauthorized access, email support@giftcue.app immediately.
• We may suspend or terminate accounts that violate these Terms.

4. What you can and can't do

You can:

• Build pickers for real people you actually intend to give gifts to.
• Share picker links however you want: text, email, social, in person.
• Mark gifts as fulfilled in your operator log.

You can't:

• Build pickers as a prank, for harassment, or to scrape gift data.
• Submit information about a Recipient that you don't have a legitimate reason to share (for example, a stranger's personal info).
• Use the service to send spam, scam, or unlawful messages.
• Reverse-engineer, scrape, or rate-limit-attack the service.
• Resell access without our written permission.
• Use automated bots to create sessions.

5. Recipient interactions

When you create a picker, you're telling us you have a reasonable relationship with the Recipient and can plausibly explain why you're giving them a gift. We don't store Recipient PII (phone, email, address) beyond what's needed for the picker to work. You're responsible for sharing the picker link with the Recipient through your existing communication channel. We don't send anything to them on your behalf without your explicit action.

6. Pricing and payments

Current pricing

• $7 per gift picker, charged at the time of build. One-time payment, no subscription.

We may introduce additional plans in the future. Any new pricing tier will be announced before it takes effect, and existing pickers will not be charged retroactively.

Payment processor

All payments are processed by Stripe. We don't see or store your full card number. You agree to Stripe's terms as a condition of payment.

Refunds

See our full Refund Policy. In summary: if the AI fails to generate, we refund automatically. If you're unhappy with the options or the Recipient experience, contact us within 7 days at support@giftcue.app and we'll regenerate at no cost or refund the $7.

7. Gift fulfillment

The picker tells you what the Recipient chose. You are responsible for actually buying or arranging the gift.

We don't guarantee that any specific business or product shown in the picker is currently operating, accepting bookings, or has stock. We make a reasonable effort to use real local businesses (via Google Places and similar APIs), but we're not responsible if a recommended venue is closed, sold out, or changes its services.

8. Intellectual property

GiftCue and all related software, content, branding, and AI prompts are owned by True Grit Toolkits LLC. You get a personal, non-exclusive, non-transferable license to use the service. You can't copy, redistribute, or build a competing product using our service.

Content you input (your descriptions of the Recipient, your notes) remains yours. By inputting it, you grant us a limited license to use it to generate the picker and operate the service.

AI-generated content (the picker options, the hero images) is provided "as is." You can use it however you want for personal gift-giving. Commercial reuse without permission is prohibited.

9. Disclaimers

GiftCue is provided "AS IS" without warranties of any kind. We make no guarantee that:

• Every Recipient will love every option.
• Every local business shown is still operating.
• The service will be uninterrupted, error-free, or perfectly available.
• The AI will never make a mistake or generate something unexpected.

10. Limitation of liability

To the maximum extent allowed by law, GiftCue's total liability for any claim relating to the service is limited to the greater of: (a) the amount you paid us in the 12 months before the claim, or (b) $100. We're not liable for indirect, incidental, consequential, or punitive damages.

11. Termination

You can stop using GiftCue and delete your account anytime. We can suspend or terminate accounts that violate these Terms. Upon termination, your sessions and account data are deleted within 30 days (except records we're required to keep for tax or legal reasons).

12. Governing law

These Terms are governed by the laws of the State of Oregon, USA. Any dispute will be resolved in the state or federal courts located in Lane County, Oregon. You and we both waive jury trial for any dispute. We both waive participation in class actions.

13. Changes to these Terms

We may update these Terms. Material changes will be announced via email (to account holders) and posted here. Continued use after changes means you accept them.
